This is an application for listing the Criminal Appeal No.913 of 2004 on the final hearing board. Learned counsel for the applicant invited my attention to the orders passed in the past on 18/03/2021, 06/04/2021 and on 15/03/2022. Vide the last order, it was directed that the Appeal be listed on the final hearing board in the week commencing from 11/04/2022. As of today the matter is not appeared on the weekly final hearing board. Learned counsel for the applicant pointed out that the applicant is 78 years of age. Considering these submissions, this Appeal be listed on the weekly final hearing board commencing from 06/03/2023. If the matter does not reach within a reasonable time, learned counsel for the applicant is permitted to mention the matter for taking it up for final hearing.

Learned counsel Shri. Kuldeep Patil for the CBI pointed that, in the Appeal Memo the Respondent is mentioned as ' State of Maharashtra', ACB, GMU. In fact, the prosecution was at the instance of CBI (ACB) Mumbai. Therefore, it is necessary that CBI (ACB) Mumbai is made a separate party in this appeal. 4.
Leave to amend for that purpose, to correct the description of the respondent and to add the CBI (ACB) Mumbai as a party respondent, is granted. Amendment shall be carried out forthwith.
