The learned Counsel for the parties inform this Court that disputes in the Appeal and the Petition have been settled and that Consent Terms have been drawn. It is submitted that the Appeal as well as the Petition can be disposed of as per the Consent Terms. 2.
The Consent Terms are signed by the representatives of the parties and their respective advocates.

The Consent Terms are taken on record and marked "X" Shrikant

The undertakings given in the Consent Terms are accepted as undertakings to this Court.

Consequently Arbitration Appeal No. 8 of 2021 and Arbitration Petition No. 34 of 2021, are disposed of as per the Consent Terms.

A soft copy of the Consent Terms shall be uploaded as second order in the matter.
7.
The hard copy of the Consent Terms signed by the parties and their Counsel shall be retained on the file and shall not be sent for destruction in ordinary course.
8.
In view of the disposal of the Appeal and the Petition, pending applications, if any, stands disposed of. 9.
This Court has taken a note of paragraph no. 4 of the Consent Terms, whereby the Plaintiff has agreed to the Defendant disposing of the remaining stock within twelve weeks from today. All concerned departments, including the Excise Department, to act upon the order passed by this Court.
