Mr. Desai states that the borrower and respondent no.2 have settled the matter and a sum of Rs.1 lakh has been paid to respondent no.2 in part settlement of the outstanding amount of Rs.6 lakhs. Mr. Desai states that therefore, respondent no.1 or respondent no.2 will not be taking possession of the subject property.

In view of the statement made, nothing remains in the petition. Petition disposed.
