Heard the learned Counsel for the applicant.

This is second application for bail. The first application was withdrawn on 16th March, 2023.

The learned APP, on instructions, informed the Court that the trial has commenced and three witnesses have been examined.

In view of the aforesaid statement, the learned Counsel for the applicant seeks leave to withdraw the application. The learned Counsel, however, submits that as the applicant has been in custody since 29th December, 2019, the trial be expedited.

As the trial has already commenced and the applicant has been in custody since December, 2019, the prayer for expeditious conclusion of the trial appears justifiable. 6.
The learned Additional Sessions Judge seized with Sessions Case arising out of CR No.528 of 2019, registered with Mulund Police Station is requested to make an endeavour to conclude the trial as expeditiously as possible, preferably within a period of six months from the date of the communication of this order.

In the event the trial is not concluded within the said period, the applicant shall have the liberty to revive the prayer for bail.
Application disposed.
