The learned counsel for the Petitioner submits that they filed Contempt Petition as Respondent no.6 violated the order dated 22.10.2012 passed by Civil Judge, Senior Division, Panvel in Special Civil Suit No. 309 of 2012.

It is to be noted that Petitioner has alternate remedy under Order XXXIX Rule 2A of the Code of Civil Procedure, 1908. In view of these facts, this court declined to entertain the present Contempt Petition.

Hence, Contempt Petition stands rejected. No order as to costs.
