DATE: 08 JANUARY 2015 P.C. :- 1] On the last occasion i.e. on 3 September 2014, none appeared for the petitioner. Even today when the matter is called out, none appeared for the petitioner.

2] It appears that the petitioner is no longer interested in pursuing the present petition. The petition involving identical issue i.e. writ petition no. 8932 of 2013 preferred by Shri Chidanand Nageshi Survase, the Sarpanch of the Gram Panchayat of Nandeni came to be dismissed by this Court on 23 October 2013. The decision in the said case would govern the decision in the present case as the petitioner in the present case is the Deputy Sarpanch of the very same Village Panchayat and the challenge is to the No 1/2

skc 17-WP-881-13 Confidence Motion by which the present petitioner and Shri Chidanand Nageshi Survase came to be removed from their respective posts. Obviously, it is for this reason that the petitioner is no longer interested in pursuing this matter. 3] In the aforesaid circumstances, this petition is dismissed. Interim order, if any, stands vacated. There shall be no order as to costs.
