The above Miscellaneous Civil Application is filed by the Applicant-wife seeking transfer of M.J. Petition No.A-1249 of 2016 filed by the Respondent-husband seeking dissolution of marriage between the Applicant and the Respondent pending before the Family Court at Bandra, Mumbai to the Family Court at Kolhapur. 2.

The Applicant-wife has also filed Petition bearing D.R. No.476 of 2016 seeking restitution of conjugal rights before the Family Court at Kolhapur. 3.

The Applicant is an M.B.A. who is currently unemployed. Though the parents of the Applicant are residing at Sangli, she resides with her uncle at Kolhapur. The Respondent is a Doctor who is working with Harshil Heart Hospital at Ghatkopar and is required to attend to the patients in the Intensive Care Unit (I.C.U.). Since both the parties are educated and have agreed to conduct their respective proceedings through video-conferencing, the following order is passed, by consent. (i) The proceedings filed by the Respondent-husband being M.J. Petition

kpd 2 / 2 924-MCAst-2419-2017.sxw No. A-1249 of 2016 before the Family Court at Bandra, Mumbai and the proceedings filed by the Applicant-wife being D.R. No.476 of 2016 before the Family Court at Kolhapur shall be conducted through video-conferencing. (ii) The District Court at Kolhapur shall render assistance to the Learned Judge, Family Court, Kolhapur, in conducting the proceedings through videoconferencing in Petition being D.R. No.476 of 2016 . If the District Court at Kolhapur is unable to render assistance as directed, the Applicant shall provide a laptop, WIFI and other equipments to enable the Learned Judge, to proceed with the matter through video-conferencing. Similarly, if the Learned Judge, Family Court at Bandra, Mumbai faces any difficulty in conducting the proceedings in M.J. Petition No.A-1249 of 2016 through video-conferencing, the Respondent shall provide a laptop, WIFI and other equipments to enable the Learned Judge to proceed with the matter through video-conferencing.

(iii) The Courts shall not grant any adjournment to the parties unless absolutely necessary.

(iv) All contentions of the parties are kept open. 4.
