Today when the matter came up for hearing, learned counsel for the petitioner submits that in regard to his grievance raised in the petition, the petitioner would submit a representation to the Competent Authority of the respondents and the said Authority be directed to consider the same and take appropriate decision on it in accordance with law, keeping in view the order passed by the Aurangabad Bench of this Court on 4.11.2009 in Writ Petition No.1491 of 2001.

Having considered the aforesaid submissions and keeping in

hvn 931-wp-9022.2017 view the order passed by the Division Bench of this Court on 12th August, 2011 in Writ Petition No. 4853 of 2011 in Siddheshwar Dagadu Markad and Ors. Vs. State of Maharashtra and Ors., we dispose of this petition with a liberty to the petitioner to submit a representation within two weeks from today. On receipt of such representation, the Competent Authority of respondents are directed to examine the petitioner's claim and in case the petitioner is covered by the said order dated 4.11.2009 passed by the Aurangabad Bench of this court in Writ Petition No.1491 of 2001, he be extended the benefits of the said order.

Needless to say that we have not expressed any opinion about the merits of the petitioner's claim and it is open for the respondents to pass appropriate orders in accordance with law. 4.

The decision as aforesaid be taken on the petitioner's representation within four months from the date of receipt of said representation.
