P.C.:- These are the Applications for intervention by a witness in CR No. 157 of 2016, registered with Arnala Police Station, District Palghar.
The learned counsel appearing for the Applicant submitted that the Applicant is one of the victims in the said crime and therefore, she may be allowed to intervene. The record indicates that the First Information Report is lodged by one Smita Dattatraya Bhoir. The learned APP, on instructions from the Investigating Officer, submitted that the Applicant is one of the witnesses in the said crime and her statement has already been recorded by the investigating agency on 26th January, 2018.
In the present pre-arrest bail Applications, the Applicant has no locus-standi to file an intervention Application in her individual capacity. Applications being misconceived, are accordingly rejected. 2/3
ssm 3 The Applicant, Devika Vichare, is at liberty to record her additional/supplementary statement with the police if she so desires and intends. The Investigating Officer is directed to record her supplementary statement as and when she approaches to him for the same.
