Heard learned Advocate Ms. Shweta Sangtani for the Applicant and the learned additional public prosecutor Mrs. Mane for the State.

Perused the impugned order. The learned Magistrate has refused to consider the application for travelling abroad on merits as there was stay of the Hon'ble Supreme Court on the proceedings pending before the learned Magistrate. The learned counsel submits that the stay has now been vacated. In view thereof, in my opinion, the applicant shall move the learned Magistrate afresh.

The learned Magistrate is expected to decide the application within a period of two weeks from the date of making the application. The present application is disposed of accordingly.
