Heard the learned counsel for the parties.

This application is preferred by the petitioner for modification of the order dated 21.12.2016 passed by this court directing applicant to deposit the sum of Rs.20.0 lakhs in the Registry of this court on or before 21.1.2017.

By this Civil Application, applicant made prayer clause (a) for allowing them to deposit the title deeds of their property instead of depositing the amount in the Registry and or to provide bank guarantee.

After hearing for some time, the learned counsel for the applicant after taking instruction Mohite 1/2

12 caw267-17 from his client makes a statement that they do not want to press the present Civil Application. He submits that applicant may be permitted to comply the order dated 21.12.2016 passed by this court i.e. to deposit sum of Rs.20 lakhs by 30.04.2017. To that effect, he has given in writing on farad. Same is taken on record and marked 'X' for identification. Same is accepted. Hence, following order is passed:

a) Civil Application stands dismissed as withdrawn.

b) Applicant is permitted to deposit sum of Rs.20.0 lakhs in the Registry of this court on or before 30.04.2017 as per earlier order dated 21.12.2016 passed by this court.
