The petition is filed seeking directions to the Respondents to register an FIR on the basis of the Petitioner's complaint dated 9th December 2015, copy of which is annexed at Exhibit-A to the petition.

Mrs. Deshmukh, learned APP for the State, having taken instructions from the officer concerned makes a statement that on the basis of Petitioner's said complaint, FIR has already been registered with Kurla Police Station against three accused persons for the offence punishable under section 406 read with 34 of the Indian Penal Code, 1860, being CR. No. 3 of 2016. Statement is accepted.

Learned Counsel appearing for the Petitioner however makes a grievance that appropriate penal provisions are not applied in the said FIR. Learned APP submitted that the patilsr 1 / 2

Investigating Officer will record the supplementary statement of the Petitioner and after examining the same, will take appropriate decision. Statement is accepted. 4.

In view of the above, nothing survives for consideration in this writ petition and the same is therefore disposed of.
