IN THE HIGH COURT OF JUDICATURE AT BOMBAY

CIVIL APPELLATE JURISDICTION REVIEW PETITION NO. 29 OF 2014 IN SECOND APPEAL NO. 277 OF 2013 Vilas Eknath Kapare & Ors.

..... Petitioners

VERSUS

Smt.Anjanabai Kaluram Mapare & Ors.

..... Respondents Mr.P.S.Dani, Senior Advocate, i/b. Mr.Nilesh Wable for the Petitioners. Mr.R.N.Sanghavi for Respondent nos. 2 to 4.

Mr.Akshay Shinde for Respondent No.5.

CORAM :

R.D. DHANUKA, J.

DATED :

3rd MARCH, 2016 P.C.

This review petition has been filed inter alia praying for recall of the order dated 24th October, 2013 on the ground that though several questions of law were raised in the appeal memo, only few questions were urged. 2.

A perusal of the order passed by this court on 24th October, 2013 clearly indicates that the learned counsel appearing for the appellants had restricted her arguments only to ground (c) and (d) of the appeal memo. This court has dealt with those grounds in the said order dated 24th October, 2013. 3.

In my view this review petition is thus not maintainable and is rejected. 4.

Mr.Dani, learned senior counsel for the review petitioners seeks continuation of the ad-interim order passed by this court on 20th November, 2015 to enable the applicant to challenge the order before the Supreme Court. The application for continuation of the ad-interim order is opposed by the learned

kvm 2/2 11-RPS29.14 counsel for the decree holder.

5.

The ad-interim protection granted by this court on 20th November, 2015 to continue for a period of four weeks from today. [R.D. DHANUKA, J.]
