Heard. Both the counsel submit that the matter is settled out of court. They submit that the Appellant as well as the Respondent are present in court. Both the parties entered into witness box and they accept the contents of the Consent Terms and execution of the same. The Consent Terms are taken on record and marked "X" for identification. The undertakings given in the Consent Terms are accepted.

501.159.14-fca.doc The Family Court Appeal stands disposed of in terms of the Consent Terms. The Consent Terms be treated part and parcel of the decree. No order as to costs.

In view of disposal of the Family Court Appeal by way of Consent Terms the learned counsel for the Appellant in the Cross Objection submits that he received instructions from his client to withdraw the cross-objection as well as the Civil Application. To that effect, he has given in writing. Same is taken on record and marked "X" for identification.

The cross-objection and the Civil Application stand disposed of as infructuous.
