The learned APP on instructions from the Investigating Officer submitted that the investigation pertaining to the present crime is on the verge of completion. That the medical certificate issued to the complainant Smt. Bharati Rane discloses that the injury received by her is on the right forearm and is simple in nature. She further on instructions submitted that the custodial interrogation of the applicant is not necessary.

In view of the above, interim relief granted on 28th January 2016 is hereby confirmed. However, the applicant is directed to attend the Nalasopara Police Station as and when call for between 10.00 a.m. to 2.00 p.m. till filing of chargesheet.

It is needless to say that before calling the applicant to the police station, the Investigating Officer shall issue notice to the applicant under Section 160 of Cr. P.C. The application is allowed in the aforesaid terms. (A.S. GADKARI, J.)
