We have heard Mr. Ambetkar, learned counsel for the petitioner.

It is submitted that the advertisement is issued after the order was passed in Original Application No. 260 of 2021 dated 5th April, 2022. It is submitted that the said order dated 5th April, 2022 in Original Application No. 260 of 2021 is stayed by the Aurangabad Bench by order dated 25th January, 2023 in Civil Application No. 789 of 2023 in Writ Petition No. 5528 of 2022. 3.

The matters are pending before the Tribunal. The Tribunal has only observed that the other side is also required to be heard as the matters are relating to recruitment rules and the learned AGP submits that now the matters are kept before the Tribunal on 10th February, 2023.

In view of that, there is no eminent apprehension to the petitioner.

The parties may appear before the Tribunal on 10th February, 2023 and canvass their submissions.

With these observations, the writ petition is disposed of. No costs.
