When the above Family Court Appeal is called out, the learned advocates appearing on behalf of the Appellant as well as the Respondent have stated that the dispute in the above Family Court Appeal have been settled as per the Consent Terms entered into between the parties in the Court of the Judicial Magistrate First Class, Thane in PWDV No.300003 of 2015. 3.fca.13.2021.doc therein (Appellant herein) has undertaken to unconditionally withdraw the above Family Court Appeal. They also brought to our attention that there is typographical mistake in the Consent Terms wherein the number of the Family Court Appeal is mentioned as Family Appeal No.3 of 2022 when in fact it should be Family Court Appeal No.13 of 2021. Both the parties have requested the Court that the aforesaid Consent Terms be taken on record.

In these circumstances, the Consent Terms dated 2nd August, 2023 filed before the Court of Judicial Magistrate First Class, Thane (in PWDV No.300003 of 2015) is taken on record and marked 'X' for identification.

In light of these Consent Terms the Appellant is permitted to withdraw the above Appeal. The above Appeal is accordingly dismissed as withdrawn. However, there shall be no order as to costs. 4.
