DATE: 6th FEBRUARY, 2019 P.C.:- 1] By way of present Petition, Petitioner challenges the order dated 30/11/2017 passed by the learned Administrative Tribunal, thereby dismissing the Original Application filed by the present Petitioner. 2] The grievance of the Petitioner was that though he was seniormost in the cadre of Additional Director, illegally, Respondent No.2 who was junior to him, was given the additional charge of the Office of Director on superannuation of earlier incumbent in the post. 1/2

If a person is given an additional charge of a higher post, he is not entitled to the salary of higher post. 3] In that view of the matter, even if we entertain the Petition, there would be no change in terminal benefits available to the Petitioner. The only question that remains for adjudication is purely academic in nature.

4] We are therefore not inclined to entertain this Petition. Petition is disposed of.
