Mr. S. V. Marwadi, learned counsel for the applicant at the out-set very fairly points out to us that in the light of the dismissal of Criminal Application No. 872 of 2012 on 9/10/2012, the applicant does not press for the relief prayed for in this application. The learned counsel, therefore, seeks to withdraw this application. A request, however, is made that the hearing of the appeal be expedited as the applicant in Criminal Application No. 1341 of 2013 is not in a position to file private paper book.

pdp appa-140-15 It appears that this court by its order dated 17/10/2013 in Criminal Application No. 1341 of 2013, had permitted the applicant therein to file private paper book within six weeks from the date of the order. It appears that till today private paper book has not been filed.

We accordingly dismiss this application as not pressed. We direct the Registry to ensure that a paper book is prepared as expeditiously as possible with liberty to the applicant to file an application urging for early hearing of his appeal, along with connected appeals. Application is accordingly dismissed as not pressed with the aforesaid direction.
