It is seen that prima facie the learned Magistrate has not taken into consideration the provisions of sections 118 and 139 of the Negotiable Instruments Act. Arguable points arise. Hence the appeal is admitted. Liberty to apply in case the parties arrive at a settlement. (ANUJA PRABHUDESSAI, J.)
