DATED : 2nd DECEMBER 2021 P.C:- After hearing the extensive arguments advanced by the learned counsel for the petitioner and the respondent, I deem it expedient to expedite the proceedings in the Special Civil Suit No.173 of 2016 from which the impugned order has emanated. The petitioner has challenged the order passed in Appeal by the District Judge, Nashik on 20th November 2017 which, in turn, confirm the order passed below Exhibit-5 in Special Civil Suit by the Civil Judge, Sr. Division, Nashik. Since the concurrent finding recorded against the petitioner/ plaintiff is in existence since 20/11/2017, interest of justice would be better Tilak
2/2 6 WP 2615-18.doc served if the Civil Judge, Sr. Division, Nashik is directed to conclude the proceedings of the Special Civil Suit within a stipulated period. Since the Suit is of the year 2016, it is directed that the learned Judge dealing with the Special Civil Suit No.173/2016 shall make every endeavour to conclude the proceedings in the suit on or before 31st May 2022. Respective counsel submit that they would render all their co-operation to the trial Judge for expeditious disposal, who shall determine the merits of the suit, being uninfluenced by the orders passed below Exhibit-5.
