This is an application filed under Section 438 of the Code of Criminal Procedure, 1973 for anticipatory bail. 2.

The applicant is apprehending his arrest in Crime No. 158 of 2019 registered at Radhanagari Police Station, Kolhapur for the offences punishable under Sections 406, 420, 467, 468, 471 r/w. 34 of Indian Penal Code.

I have heard the learned Counsel for the applicant and the learned APP for the State.

The bail is sought on the ground of parity. In support of the said ground, the learned Counsel for the applicant has placed on record a copy of the order dated 8 February 2022 passed in Anticipatory Bail Kanchan P Dhuri 1 / 2

27-ABA-233-2023.odt Application No. 1019 of 2020. By the said order, this Court has granted anticipatory bail to the co-accused - Santosh Verma Alluri. 5.

I have perused the FIR. According to the complainant, coaccused Santosh Alluri had issued an advertisement to provide dealership of bio-diesel outlet of his company 'My Eco Energy Company'. According to the complainant, pursuant to said advertisement, he had deposited Rs.15 lakhs in the bank account of the said company. However, later on he found that the said company was not authorized to provide dealership by Government authorities.

It appears that applicant was Director in the said company and the co-accused Santosh Alluri was Chairman of the said company. As this Court has granted anticipatory bail to co-accused Santosh Alluri, on the ground of parity, I am inclined to grant anticipatory bail to the present applicant. In the result, the following order is passed : (i) Application is allowed.

(ii) In the event of arrest of the applicant - Sachin Sahebrao Labade in Crime No. 158 of 2019 registered at Radhanagari Police Station, Kolhapur for the offences punishable under Sections 406, 420, 467, 468, 471 r/w. 34 of Indian Penal Code, he shall be released on bail on furnishing P.R. Bond in the sum of Rs.25,000/- with one or more sureties in the like amount.

(iii) The applicant shall attend the concerned police station as and when called by the Investigating Officer and shall co-operate in the investigation.
