On instructions, the learned counsel appearing for the Petitioner seeks permission to withdraw this Petition. He pointed out that by invoking Clause 58 of the Conditions of Contract, the Petitioner has filed an Appeal/Revision and the same is pending.

The Petition is disposed of as withdrawn. All contentions on merits are kept open.

If the Appeal/Revision is filed by the Petitioner before the Municipal Commissioner, an endeavour shall be made to decide the same as expeditiously as possible and preferably within a period of three months from today.
