The challenge in this Writ Petition is to the order dated 16th 1/2

4-wp-1907-2023.doc Sonali January 2023 passed by the Hon'ble Minister, Rural Development, Government of Maharashtra, Mantralaya, Mumbai, by which order dated 14th November 2022 passed by the learned Divisional Commissioner, Konkan Division, Navi Mumbai is set aside. By said order dated 14th November 2022, the learned Divisional Commissioner, Konkan Division, Navi Mumbai has removed the Respondent No.1 from the post of Sarpanch, Gram Panchayat Mankule, Tal. Alibag, Dist. Raigad.

However, Mr. Gavnekar, learned counsel appearing for the Petitioners as well as Mr. Gaware Patil, learned counsel appearing for Respondent No.1 state that the term of the Sarpanch has come to an end, the elections are declared and scheduled date of voting is 5th November 2023 and both of them state that the Writ Petition has become infructuous.

Accordingly, the Writ Petition is disposed of as infructuous, with no order as to costs.

In view of the disposal of the Writ Petition, nothing survives in the Interim Application and the same is also disposed of. [MADHAV J. JAMDAR, J.] 2/2
