The impugned order is dated 6th December 2022 being interlocutory in nature capable of being challenged under section 105(1) of the Civil Procedure Code, 1908 in an appeal if the decree goes against the petitioners, no interference under Article 227 of the Constitution of India is called for. However, it will be open for the petitioners to raise such contentions as are available in law to challenge the impugned order in the appeal in case decree is passed against the petitioners.

With the above clarification, the writ petition stands disposed of. No costs.
