This is an Application filed under Section 438 of Criminal Procedure Code, 1973 for Anticipatory Bail.

The applicant is apprehending his arrest in Crime No.271 of 2021 registered with Mumbai Naka Police Station, Nashik for the offence punishable under Section 420 r/w 34 of Indian Penal Code, 1860. 3.

I have heard learned counsel for the Applicant and learned APP for the Respondent - State.

The allegations against the present Applicant and other co-accused are of cheating the investors to the tune of Rs.2,87,00,000/-. 5.

The learned counsel for the applicant submits that the applicant is also one of the victim and has lodged the complaint against the co-accused Ravindra Darade even prior to registration of the present crime. It is 1 / 2

Vina Khadpe 23-aba-243-2023.doc submitted that allegations of inducement are against the co-accused Ravindra Darade and the trial Court has released him on bail without any condition of deposit. It is submitted that the applicant has deposited Rs.10,00,000/- pursuance to the order passed by this Court. 6.

I have perused the papers of investigation. The main allegations are against co-accused Ravindra Darade and the trial Court has released him on bail.

Considering overall facts and circumstances of the case, I am inclined to release the applicant on anticipatory bail. In the result, following order is passed;

ORDER

(i) Application is allowed.

(ii) In the event of arrest of applicant in Crime No. 271 of 2021 registered with Mumbai Naka Police Station, Nashik for the offence punishable under Section 420 r/w 34 of Indian Penal Code, 1860, he shall be released on bail on executing P.R. Bond in the sum of Rs.25,000/- with one or two sureties in the like amount.

(iii) The applicant shall attend the concerned police station as and when called by the Investigating Officer and shall co-operate in the investigation.
