Heard. By this Civil Application, the Applicant is seeking to restore the First Appeal which stood dismissed in view of conditional order dated 12.11.2009 passed by the learned Registrar (Judicial) for non removal of office objections.

The learned counsel for the Applicant submits that inadvertently it remained on their part to remove all office objections within time. He submits that the Applicant undertakes to remove all office objections within two weeks from today.

19.438.10-caf.odt the averments made in the Civil Application and as the Applicant is ready and willing to remove all office objections, following order is passed:

a.

Order dated 12.11.2009 passed by the learned Registrar (Judicial) is set aside.

b.

The First Appeal is restored to file for hearing on merits.

c.

The Applicant is directed to remove all office objections in the First Appeal on or before 31.07.2019, failing which the Civil Application shall stand dismissed without further reference to the court.

d.

If all office objections are removed within stipulated time as stated hereinabove, Office is directed to place the First Appeal on board on 09.08.2019, for directions.
