Heard the learned counsel for both the parties. 2.

This application is preferred by the Insurance Company for condonation of 29 days delay in filing the First Appeal challenging the Judgment and Award dated 3rd July, 2013 passed by the Motor Accident Claim Tribunal, Malshiras in M.A.C.P. No.23 of 2010.

Considering the submissions made by the learned Counsel for the Applicant and the averments made in the Civil Application, I satisfied that the Applicant has made out a case for allowing the Civil Application.

Civil Application is allowed in terms of prayer clause (B), which reads thus;

(B) Your Lordships be pleased to Condon delay in filing the First Appeal. The office/Registry of the Hon'ble High Court be order to registered the First Appeal presented against the impugned Judgment and order/Award dt.03/07/2013, passed by the Member, M.A.C.T. Malshiras, Dist.Solapur in M.A.C.P. No.23/2010. 5.
