This is an application for anticipatory bail in connection with C.R.No.7 of 2020, registered with Naupada Police Station, Thane City, for the ofence punishable under Section 420 read with 34 of Indian Penal Code ("IPC", for short). First Information Report ("FIR", for short) was lodged on 6th January, 2020.

rpa 2/3 905-aba-295-2020.doc In nutshell the prosecution case is as follows: The complainant has alleged that the accused has represented that of the complainant would be provided joj at BHABA Atomic Research Centre, Mankhurd, Mumbai. They induced complainant to part with an amount of Rs.4,50,000/- from time to time. Accused showed bogus identity card and fabricated letter purportedly issued by BHABA Atomic Research Centre. The said letter was shown to the complainant's son and his signatures were obtained. Applicant and others had visited the house of the complainant and at that time the complainant had parted the amount.

Learned counsel for the applicant submitted that the amount is not handed over to the applicant. He was at the most present along with the co-accused. The other accused were arrested and granted bail. Custodial interrogation of the applicant is not necessary.

Initially ofence under Sections 420 was registered. Subsequently, Sections 465, 467, 468 and 471 of IPC were added. The accused had assured that complainant's son would be

rpa 3/3 905-aba-295-2020.doc provided job with BHABA Atomic Research Centre, Mankhurd, Mumbai. To gain confdence of the complainant, the accused relied upon false identity card, bogus appointment letter, bogus merit lists etc. There are specifc allegations against the applicant. He had visited house of the complainant and other accused and collected the amount assuring employment to complainant's son. The co-accused were arrested and thereafter granted bail. Parity is not applicable to the applicant. Considering the nature of allegations against the applicant, no case for grant of anticipatory bail is made out. Anticipatory Bail Application is rejected and stands disposed of.
