Mr. Nakhawa, the learned APP has brought to my notice that the applicant has not filed any application before the Sessions Court and has approached this Court directly. In view of the statement made by the learned APP for the State, Mr. Kocharekar, the learned counsel for the applicant seeks leave to withdraw the application with liberty to file a proper application before the Sessions Court.
