Heard both the sides. The Applicant has been convicted and sentenced under section 302 IPC by the learned Additional Sessions Judge, Greater Bombay in Sessions Case No.1006 of 2006. Being aggrieved thereby the Applicant preferred Criminal Appeal No.46 of 2008. Thereafter, this Application has been preferred by the Applicant - Appellant VRD

APPA168.10 praying that his case be sent back for retrial. 2.

After hearing the learned counsel for both the sides at length and after perusing the judgment and order passed by the learned Additional Sessions Judge as well as the evidence in this case, the Appeal preferred by the Applicant / Appellant has been dismissed on merits by a detailed order.
