This is an Application under section 439 of Cr.P.C. filed by the aforesaid Applicant who is facing trial in C.C.No.1966/PW/2020 pending on the file of Metropolitan Magistrate, 10th Court, Andheri, Mumbai for offences punishable under sections 465, 467, 468, 471, 419, 420, r/w. 34 of the Indian Penal Code.

Heard Mr. Yogesh S. Palve, learned counsel for the Applicant and Ms. A.A. Takalkar, learned APP for the State. I have perused the records and considered the submissions advanced by the learned counsel for the respective parties.

The crime against the Applicant and the co-accused has been registered pursuant to the First Information Report (FIR) lodged by Kusumlata Sushilkumar Bhardwaj, the Chief Manager of Punjab National Bank, Juhu Branch. The FIR prima facie reveals that the Applicant herein claiming to be an agent, processed loan documents submitted by one Ramawadh Yadav. Said Ramawadh Yadav had availed loan of Rs.27,00,000/-. Subsequently, it was found that all the documents submitted by the borrower were forged and fabricated. The name Ramawadh Yadav was also fictitious. It was revealed that the accused no.1 - Jahid Ali Mohammad Ali Bodlaji was the actual borrower. Hence, the aforesaid crime came to be registered against the Applicant and the co-accused.

Mr. Yogesh Palve, learned counsel for the Applicant states that the main accused - Jahid Ali Mohammad Ali Bodlaji has been granted bail on 18/08/2021. He further states that the Applicant is ready to deposit Rs.2,20,000/- which was deposited in his account by the accused no.1. In view of the said statement and also considering the fact that the main accused has been released on bail and further that considerable time will be required to conclude the trial, in my considered view, the Applicant is entitled for bail. Hence, the Bail Application is allowed on 2/4

following terms and conditions :- (i) The Applicant who is facing trial in Sessions Case No.1966/PW/2020 pending on the file of Metropolitan Magistrate, 10th Court, Andheri, Mumbai is ordered to be released on bail on furnishing PR bonds in the sum of Rs. 50,000/- with one or two solvent sureties in the like amount. (ii) The Applicant shall report to Juhu Police Station, once in a month on every 1st Saturday between 11.00 a.m. to 01.00 p.m. until further orders;

(iii) The Applicant shall not interfere with the witnesses and/or shall not tamper with the evidence or attempt to influence or contact the complainant, witnesses or any person concerned with the case;

(iv) The Applicant shall keep the Trial Court informed of his current address and mobile contact number and/or change of residence or mobile details, if any, from time to time. (v) The Applicant shall co-operate with the conduct of the trial and attend the trial Court on all dates, unless exempted. 3/4
