This is an application under Section 438 Cr.P.C. filed by the aforesaid applicant apprehending his arrest in C.R.No. 8 of 2023 registered with V.P.Marg Police Station for offences under Section 420, 465, 468, 471, 473, r/w. 34 of the Indian Penal Code. 2.

Heard Mr. Patil, learned Counsel for the Applicant and Mr. Gavand, learned APP for the State. I have perused the records and considered the submissions advanced by the learned Counsel for the respective parties .

By Order dated 25.01.2023 this Court (Coram M.S.Karnik. J.) had granted interim bail to the Applicant with further directions to report to the Investigating Officer on 30.01.2023 and 31.01.2023. Learned Counsel for the Applicant states that pursuant to the said order, the Digitally signed by PRASANNA P SALGAONKAR Date:

19-ii-aba-250-23.doc interrogated. The Applicant is one of the Distributors of Ferrix Carboxymaltose injection, which was manufactured by M/s. Emcure Pharmaceuticals. There is no prima facie material on record to show the involvement of the Applicant in the aforesaid crime. .

Considering the above facts, and in view of the reasons stated in order dated 25.01.2023, interim bail stands confirmed. Hence the order:- (i) In the event of arrest of the Applicant in Crime No.- of 2023 registered with V.P.Marg Police Station, the applicant be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twentyfive Thousand Only) with one or two sureties in the like amount, to the satisfaction of the Investigation Officer.

(ii) Applicant shall report to the Investigating Officer as and when required by the Investigating Officer for the purpose of investigation and interrogation.

(iii) Applicant shall provide his permanent as well as temporary address, if any, and his mobile/ contact details to the Investigating Officer and keep informed the Investigating Officer about the change in residence/ contact number, if any, from time to time, (iv) Applicant shall not interfere with the complainant and the other witnesses in any manner.
