Heard. This application is for bringing legal heirs on record of deceased respondent No.4 Mrs. Sharayu Sharad Shindikar who died on 02.07.2015.

Adv. Mr. Mahajan submits that he received instructions to appear on behalf of legal heirs of deceased respondent No.4. He submits that they have no objection if the Civil Application is allowed.

Considering the submissions made by the learned counsel for the Applicant and as the Basavraj G Patil 1/2

14.354.16-caw advocate appearing for the legal heirs of deceased respondent No.4 has no objection, following order is passed:

a.

Delay in making the Civil Application is condoned.

b.

Abatement is set aside.

c.

The applicant is permitted to bring on record the legal heirs of deceased respondent No.4 on or before 18.11.2016, failing which the Civil Application shall stand dismissed without further reference to the court.

d.

If amendment is carried out within stipulated time as stated hereinabove, the applicant is directed to provide an amended copy of the Writ Petition to the advocate for the respondent.

e.

Civil application stands disposed off accordingly.
