The Applicant is seeking anticipatory bail in connection with C.R.No.1 of 2024, registered at Supa Police Station, Pune Rural, on 01.01.2024, under sections 452, 324, 327, 323, 504, 506, 143, 147, 149 and 427 of the Indian Penal Code. 2.
Heard Mr. Ranjeet Pawar, learned counsel for the applicant and Ms. Mahalakshmi Ganapathy, learned APP for the State.

The F.I.R. is lodged by one Anjali Jadhav. She has stated that the incident occurred on 31.12.2023 at about 9.30p.m. Digitally signed by VINOD BHASKAR GOKHALE Date:

She was residing with her husband Navnath, her daughter, son and her mother in law. At the time of the incident, two women and two men entered their house and started abusing the informant' s husband Navnath. One of the women told her that her name was Maya and she was Navnath's first wife. She started abusing the informant, as well. There was some scuffle and Navnath and the first informant were assaulted. The applicant Maya removed a file containing the documents and Rs.20000/-. One of them broke the informant's phone. After some time, all of them left the informant' s house. On these allegations the F.I.R. is lodged. 4.
Learned counsel for the applicant submitted that the applicant is residing separately from Navnath for past 10 years. She only wanted to collect her documents. The applicant has already filed proceedings U/s.125 of the Cr.p.c. against Navnath. Those proceedings are still pending. The applicant only wanted her documents. There was no intention of committing any other offence.

Learned APP produced the relevant investigation
papers before me. They contain statements of Navnath, his mother and some neighbours. They have corroborated the allegations in the F.I.R. The medical certificate shows that Navnath had suffered redness of eye and the injury was mentioned as simple injury. Besides this, there is no other injury certificate showing injury to any other person.

I have considered these submissions and these circumstances. There is hardly any injury to anybody from the informant's family. Only Navnath had suffered redness of eye, but it was described as a simple injury. There are matrimonial disputes between the applicant and Navnath. In this background, the incident does not appear to be very serious. The custodial interrogation of the applicant will not serve any purpose. She can be protected by an order U/s.438 of the Cr.p.c. 7.
Hence, the following order :
O R D E R
i) In the event of her arrest in connection with C.R.No.1 of 2024, registered at Supa Police
Station, Pune Rural, the applicant is directed to be released on bail on her executing P. R. bond in the sum of Rs.30,000/- (Rupees Thirty Thousand Only) with one or two sureties in the like amount.
ii) The Application is disposed of.
