IN THE HIGH COURT OF JUDICATURE AT BOMBAY
CIVIL APPELLATE JURISDICTION WRIT PETITION NO.1284 OF 2018 Sharadchandra Tarachand Mehta ... Petitioner Vs.
Anita Pradeep Venkatrao & ors ... Respondents ---- Ms.Ferzana Behramkamdin with Ms.Shlesha Sheth I/b FZB Associates for Petitioner.
Mr.P.K.Dhakephalkar Sr.Advocate with Mr.Jaydeep Deo for Respondent nos.1 and 2.
---- CORAM : G.S.KULKARNI, J.
DATE : FEBRUARY 21, 2018.
P.C.:
1.
Heard learned counsel for the parties.
2.
In raising a challenge to the order dated 8.1.2018 passed by the learned Judge, Small Causes Court at Mumbai the only concern of the petitioner is that the inspection which has been permitted to the respondent nos.1 and 2 shall happen in a peaceful manner looking at the past allegations as made by the parties against each other. If this is the only concern and anxiety, then it would be appropriate that inspection be undertaken by the respondent nos.1 and 2 as directed by the learned trial Judge in presence of an independent Observer who would remain present
at the time respondent nos.1 and 2 take the inspection and only to observe that it happens in a peaceful manner and no untoward incident takes place.
3.
Accordingly, the Member-Secretary, Maharashtra State Legal Services Authority, Mumbai is directed to depute a responsible Officer to remain present at the inspection and make a report only in the event there is an untoward incident/misbehaviour by any of the parties.
4.
Parties are directed to keep the Member-Secretary, Maharashtra State Legal Services Authority, Mumbai informed of the date, time and place of the inspection.
5.
The petition therefore would not warrant any further adjudication. It is accordingly disposed of in above terms. No costs.
6.
A copy of this order shall be forwarded to the Member-Secretary,Maharashtra State Legal Services Authority,Mumbai.
