Heard learned counsel appearing for the Petitioner and learned APP appearing for Respondent-State. Learned APP has tendered across the bar, a letter written by Senior Inspector, Shivaji Nagar Police Station, Bhagyawant

2/2 3-APPW-42-18+.doc Ambarnath (East), addressed to Public Prosecutor, High Court, Bombay, same is taken on record.

Learned APP relying upon the contents of the said letter submits that, during the course of investigation of Crime No. 182/2015 under Section 498 (A), 364, 306, 504, 506 of Indian Penal Code registered with Shivaji Nagar Police Station, Ambarnath (East), the investigating officer found clothes and articles, and thereafter added Section 306 of IPC. He submits that, the charge sheet is already filed. Learned APP submits that, in view of aforesaid development during the course of investigation of aforesaid crime, Monica cannot be produced before this Court.

In the light of discussion made in foregoing paragraphs, nothing survives for consideration. Hence, writ petitions stands disposed of. 4.

Since, the writ petition is disposed of, there is no need to adjudicate the Criminal Application No. 42/2018 and same also stands disposed accordingly.
