Not on Board. At the request of Mr. Daswadikar, taken up in production board. Heard Mr.Daswadikar, learned counsel for the petitioner.

By this Petition under Article 227 of the Constitution of India, the petitioner has challenged order dated 16.11.2015 passed by the learned Civil Judge, Jr. Dn., Mahad-Raigad, below Exh.5. By that order, the learned trial Judge issued show cause notice to the defendant as to why ad-interim injunction as sought for should not be granted to the plaintiff.

Mr. Daswadikar states that aggrieved by this order, the petitioner preferred Misc.Appeal before District Court. He, therefore, seeks to withdraw this Petition.

On the motion made by Mr. Daswadikar, Petition is allowed to be withdrawn. It is made clear that I have not examined merits of the case.

All the parties including District Court to act on the authenticated copy of this order.
