The Petitioner is a partnership firm engaged in the business of manufacturing of speed limit devices (SLD). Respondent No. 1 is the Transport Commissioner, State of Maharashtra. Respondent No. 2 is the Regional Transport Officer, Nashik. Respondent No.3 is the State of Maharashtra. 2.
Since the Respondent No. 1 received complaints qua the speed limit devices manufactured by the Petitioner, the same was conveyed to the Petitioner on 31st March, 2017. After certain correspondence, notices dated 14th September, 2017 and 12th January, 2018 were issued to the Petitioner by Respondent No. 2. Thereafter, on 16th January, 2018, a show cause notice was issued to the Petitioner to explain why the Petitioner should not be blacklisted. The Petitioner therefore filed the above Writ Petition impugning the said show cause notice.

Since the Petitioner is only served with a show cause notice, and no coercive action will be taken against the Petitioner only after considering its reply, no interference is called for at this stage under Article-226 of the Constitution of India. However, the Petitioner shall be at liberty to impugn if the decision taken by the Respondents after considering its response to the Show Cause Notice is adverse to the Petitioner.
