This is an application for anticipatory bail in CR. No. I- 401 of 2018 registered with Bhiwandi City Police Station for the offences punishable under Sections 454, 457, 380 read with 34 of the Indian Penal Code.

The co-accused has been granted pre-arrest bail by this Court in ABA No. 181/2019 by order dated 23rd January, 2019. It appears that the role attributed to the co-accused was the same as attributed to the Applicant. Even otherwise except
2 of 3 908 aba 313-20.doc statement of disclosure made by the co-accused suggesting complicity of the Applicant in the crime no other evidence has been brought to my notice against the Applicant. 4.
Considering the aforesaid circumstances, no case is made out for the custodial investigation. Application is allowed. Hence, the following order:
ORDER
i) In the event of arrest of Applicant in connection with C.R. No. I-401 of 2018 registered with Bhiwandi City Police Station the Applicant shall be released on bail on furnishing P.R. bond in the sum of Rs. 25,000/- with one or more sureties in the like amount;
ii) The Applicant shall report Investigation Officer on 12th and 26th of February, 2020, between 11.00 a.m. to 1.00 p.m.
iii) The Applicant shall furnish the particulars of his place of residence and contact details to the Investigating Officer of the concerned Police Station within seven days from today.
3 of 3 908 aba 313-20.doc iv) The Applicant shall not tamper with the evidence or attempt to influence or contact the Complainant, witnesses or any person concerned with the case. v) It is made clear that observations made hereinabove shall be construed as expression of opinion only for the purpose of granting bail and the same shall not in any way influence the trial in other proceedings.
