The learned counsel for the Applicant submits that till today notices are not issued in Writ Petition Therefore, there is no question of issuing notice to Respondent in Civil Application also.

By this Civil Application, Applicant is seeking permission to bring them on record as legal heirs of deceased sole Petitioner. He submits that sole Petitioner expired on 23.06.2018. Considering the submissions made by the learned counsel for the Applicant and the averments made in the Application, I am satisfied that the Applicant has made out a case for allowing the present Civil Application. Hence, following order: a) Delay in filing Civil Application is condoned. b) Applicant is permitted to carry out amendment in Writ Petition as per Schedule no.1 and 2 on page 6 and 7 of the present Civil Application.
c) Amendment be carried out on or before 22.02.2019, failing which the Civil Application shall stand dismissed without further reference to the court.
