Learned A.P.P on instructions, states that the police intends to file a supplementary charge-sheet, essentially with regard to the proof of age of the prosecutrix within one week from today. The said statement is accepted. 2.
In view of the statement made by the learned A.P.P, learned Counsel for the applicant, on instructions, seeks leave to withdraw the application with liberty to file a fresh application before the trial Court after filing of the chargesheet. 3.
Accordingly, the application is disposed of as withdrawn with liberty as prayed.

It is made clear that if an application is preferred by the applicant before the trial Court after filing of the supplementary charge-sheet, the learned Judge shall consider the same on its own merits, on the basis of the material in the supplementary charge-sheet, uninfluenced by the withdrawal of this application.
