This Writ Petition has been pending in this Court from 6 December 2017, for "pre-admission" stage. The Petitioners herein are the original Plaintiffs, to whom the suit was dismissed and an Appeal against the said decree, which was dismissed for want of prosecution. An application for restoration was filed 1/2

14-WP-294-2018.doc before the Appellate Court without any prayer for delay condonation. The said application for restoration was dismissed by an order dated 3 May 2014. The present Writ Petition challenges the said order dated 3 May 2014.

It has been seen that the advocate for the Petitioners on the previous occasions viz. 16 July 2019, 30 July 2019, 13 August 2019, 27 August 2019, 11 September 2019, 17 July 2023, 17 August 2023 and 24 August 2023, have shown incapacity to argue this matter. Even today the arguing counsel is not available to argue this matter.

The Writ Petition is accordingly dismissed.
