1] This writ petition is preferred challenging the order 03.10.2015, passed by Judge Family Court, in Petition A. No.482 of 2014. The said order was of "No cross" of the applicant in the said petition, on the ground that the respondent wife was absent therein. Respondent wife had filed an application for setting aside the said order of, "No cross", but application was rejected by the trial Court, by order dated 31.10.2015.

33 WP 9785 OF 2016.odt 2] Today, the husband Abhay Shivaji Tupe is present in person and submits that he has no objection to set aside the order of, "No cross".

3] In view thereof, the impugned order of "No Cross" is set aside and the petition is allowed in terms of prayer clause (a) and (b) of the petition.
