1. Learned counsel for the Appellant submits that since the Appellant is arrested, the prayers in the Appeal have become infractuous. Hence, he seeks liberty to withdraw the Appeal.

2. Liberty as prayed for is granted in the interest of justice. It is made clear that we have not gone into the merits of the matter and the withdrawal of the Appeal shall not be treated as an impediment to hear the Appeal on merits.

3. Learned APP has filed a report wherein it is shown that the Appellant / accused Walmik Popat Shinde had surrendered before the police on 09.02.2022 and he shown to be arrested at 6:00 p.m.
