Heard learned counsel for the applicant and learned APP.

This is an application for pre-arrest bail. The applicant is apprehending arrest in connection with C.R. No.1438 of 2022 dated 20/11/2022 registered with Samtanagar Police Station for offence punishable under sections 141, 143, 145, 147, 148, 427, 448 of the Indian Penal Code, 1860 ("IPC", for short). Subsequently, the offence under sections 452, 465, 467, 468 and 471 of the IPC were added.

The dispute is in respect of a room no 26 situated at Samtanagar, Kandivali East. There is an order passed by this Court on 03/01/2023 in Anticipatory Bail Application No. 3590 of 2022 rejecting the application of the coaccused-Rakesh Awadhesh Singh alias Rakesh Awadh Singh. The allegation was that co-accused-Rakesh Awadhesh Singh - alias Rakesh Awadh Singh forcibly removed the tenant from the suit premises and inducted himself there. The FIR though mentions that the tenant was in possession of the room and the applicant forcibly removed the tenant, learned counsel for the applicant submits that neither is the applicant in possession of the said room which is the subject matter of the FIR nor he is claiming any right over the said room, neither has he any concern whatsoever with said room.
The applicant is not claiming any right including that he is in possession of the said room. In this view of the matter, the custodial interrogation of the applicant is not necessary, however, the applicant must co-operate with the investigation. There are no criminal antecedents reported against the applicant.
Hence, the following order.
O R D E R
(a) The application is allowed.
(b) In the event of arrest of the applicant in connection with C.R. No.1438 of 2022 dated 20/11/2022 registered with Samtanagar Police Station, the applicant-Ravindra Chandrabhan Singh @ Pintu Singh be released on bail on his furnishing P.R. Bond in the sum of Rs.25,000/- with one or more sureties in the like amount; (c) The applicant shall not directly or indirectly make any inducement, threat or promise to any person acquainted with facts of case so as to dissuade him from disclosing the facts to Court or any Police Officer and should not tamper with evidence;
(d) The applicant shall attend the investigating officer on 01st and 2nd February 2023 between 11.00 a.m. and 1.00 p.m. and thereafter as and when called for.
