The learned APP submits that the charge is framed against the present applicant in Sessions Case No. 154 of 2012 pending before the Additional Sessions Judge, Kalyan. The prosecution has examined most of the witnesses and only two witnesses are to be examined.

In view of this, it would not be appropriate to consider an application under Section 439 of Cr.P.C. The learned Sessions Court shall not grant unwarranted adjournments to the prosecution or to the defence in the midst of the trial.
