The Applicant is seeking regular bail in Crime No. 427 of 2017 for an offence punishable under Sections 420, 406, 504, 506 read with Section 34 of the Indian Penal Code. After the arrest on 19th November 2017 the Applicant came to be chargesheeted. 2.

The prosecution case is, after the Government of India declared demonetization, the Applicant along with his wife has promised the Complainant of exchange of currency to the tune of Rs.1.00 Crore and duped the Complainant.

The Applicant is a public servant i.e. Constable in the police department. The role attributed to the Applicant is that of aiding and assisting the main accused Anita who happened to be his wife. Nothing incriminating is recovered from the Applicant, whereas from his wife Anita, substantial amount involved in the crime came to be recovered. 4.

The learned Counsel for Applicant claimed that there are no criminal antecedents against the present Applicant. That being so, in my opinion, a case for grant of bail is made out. Hence the following order.

ORDER

(A) The Applicant be released on bail in Crime No. 427 of 2017 for an offence punishable under Sections 420, 406, 504, 506 read with Section 34 of the Indian Penal Code on executing PR Bond of Rs. 50,000/- with one or more sureties in the like amount. (B) The Applicant shall remain outside the revenue jurisdiction of Raigadh till conclusion of trial, but for attending the Court, considering that he was a Police Officer.

(C) The Applicant shall neither tamper the evidence of prosecution nor influence the prosecution witnesses.
