The above Civil Application has been filed for the deletion of the Respondent No.3 from the array of the Respondents as he is not a necessary party to the above Petition considering the challenge raised in the above Petition. The Learned Counsel appearing on behalf of the original Petitioner Mr. Deodhar points out that in view of the relief sought vide prayer clause (b) that the Respondent No.3 has been joined as a party Respondent to the above Writ Petition. In my view since the challenge to the above Petition is to the order passed in the departmental proceedings against the Petitioner, the presence of the Respondent No.3 for adjudication of the above Petition is not necessary. The Civil Application is accordingly allowed. The Respondent No.3 is mmj

caw-2292-15(8) accordingly allowed to be deleted. However, consequentially the Petitioner herein is also allowed to amend the prayer clause (b) so as to claim the relief against the Respondents rather than the Respondent No.3. The Civil Application is accordingly disposed of.
