It is an admitted position that in view of the subsequent transaction in respect of the suit properties, the new purchaser is required to be brought on record. In these circumstances and inasmuch as the suit is of the year 2008, I am not inclined to interfere with the impugned order dismissing the Application of the Appellant for injunction.

Learned Senior Counsel for the Appellant states that the Appellant would make appropriate Application before the trial Court to bring the name of the subsequent purchaser on record in the plaint. Let that be done at the earliest.

45-caa-1187-2014 The Appeal from Order is disposed of with a direction that the trial Court shall endeavor to decide the suit expeditiously and preferably before 2018 year end.

The Civil Application does not survive and shall stand disposed of .
